How does Texas adopt the NEC?

Texas adopts the NEC statewide through TDLR. The 2026 NEC took effect 2026-09-01 (16 TAC 73.100) with one amendment: 210.8(F) Exception No. 2, which exempts listed HVAC equipment from GFCI protection, applies without the NEC's September 1, 2026 expiration. Every earlier edition since 2004 was adopted as published, except that the 2020 NEC's 210.8(F) was not required from November 2021 until the 2023 NEC took effect. TDLR treats the state-adopted code as the minimum standard for covered electrical work inside and outside city limits; cities may adopt local amendments (Occupations Code 1305.201(c)), which TDLR says should keep equivalent safety under NEC 90.4, and work inside city limits must also follow the city's ordinances (1305.201(d)).

What are Texas's amendments to the NEC?

210.8(F): Exception No. 2 applies without expiration: outdoor outlets supplying listed HVAC equipment need no GFCI protection. The unamended 2026 NEC ends that exception on September 1, 2026 (16 TAC 73.100(b)).

Who issues electrical permits in Texas?

Cities issue permits and inspect under their own ordinances, including local amendments (Occupations Code 1305.201). In unincorporated areas the work must meet standards at least as stringent as the state electrical code (1305.201(e)), and local permit and inspection coverage may be limited.

TDLR applies it to non-exempt work started on or after that date; for work under a permit, the permit date counts as the start (TDLR guidance).
